Terms of Service.
By enrolling in any DaSilva-Lining Coaching & Consulting Program you agree to the following terms of service.
For the purposes of these Terms of Service, “Coach” refers to DaSilva-Lining Coaching & Consulting, and “Client” refers to the enrollee.
Services Provided
The coach will provide life coaching services focused on personal growth, goal achievement, and professional development. Coaching is not counseling, psychotherapy, mental health services, consulting, or medical treatment. The coach will not diagnose or treat any mental health conditions.
Disclaimer of Therapeutic Services
Client acknowledges and agrees that:
Coaching is not a substitute for therapy, counseling, or psychotherapy.
The Coach is not acting as a licensed medical, mental health, or other professional unless otherwise explicitly stated.
No therapeutic, mental health, counseling, or medical services are being provided under this agreement.
If the Client requires mental health support, the Client agrees to seek the services of a qualified professional provider.
Coaching vs. Therapy Clause
The Client acknowledges that the services provided by the Coach under this agreement are strictly life coaching services and do not constitute mental health therapy, counseling, psychological treatment, or medical care as defined under state law. The Coach is not working in the capacity of a licensed mental health professional unless explicitly stated and does not diagnose, treat, or prescribe for any mental health conditions.
The Client understands that coaching is a collaborative process focused on personal and professional development, and it is not intended to replace evaluation, diagnosis, or treatment by a licensed therapist, psychologist, psychiatrist, or any other health care professional.
If the Client requires mental health services or therapy, the Client agrees to seek assistance from a licensed mental health provider in the State of Rhode Island. The Coach will not be responsible for any mental health conditions, issues, or disorders that exist prior to or arise during the coaching relationship.
Licensed Professional Disclaimer Clause
Although the Coach is a licensed mental health professional in the state of Rhode Island, the Client acknowledges and agrees that the Coach is not operating in that capacity during the coaching relationship. The Coach provides coaching services only, which do not include diagnosis, treatment, or management of mental health disorders, nor do they constitute therapy, counseling, or psychological services as defined by Rhode Island law.
The Coach will not utilize the Coach’s mental health licensure or provide any therapeutic interventions within the scope of coaching services. If at any point the Client requires mental health services, therapy, or counseling, the Coach will refer the Client to a qualified licensed professional acting in that capacity.
This separation is intended to ensure compliance with ethical and legal guidelines and to clarify that the coaching engagement is not a therapeutic relationship, regardless of the Coach's professional licensure or clinical training.
Confidentiality
All information shared is confidential except as required by law. As a mandated reporter in the state of Rhode Island, The Coach is legally obligated to report concerns involving harm to self or others, child abuse or neglect, or abuse of vulnerable adults. Coaching is not clinical therapy or mental health treatment, therefore, it is not governed by HIPAA or other health-care privacy regulations.
Fees, Payments, and Cancellations
All session fees are due at the time of booking unless otherwise stated in writing. By scheduling a session, the client acknowledges and agrees to the terms outlined in this cancellation and payment policy.
To honor your time and the integrity of our scheduling process, clients are required to provide a minimum of 48 hours’ notice to cancel or reschedule any session. Notice must be submitted through the designated scheduling system.
Cancellations made less than 48 hours before the scheduled appointment time, as well as missed or “no-show” sessions, are considered late cancellations and are non-refundable.
Term and Termination
Either party may terminate this agreement at any time with prior written notice.
Limitation of Liability
The Coach shall not be held liable for any decisions or actions taken by the Client as a result of coaching.
Governing Law
This agreement shall be governed by the laws of the State of Rhode Island.
